FoodConnect is a food delivery coordination service that connects customers with local restaurants in the United States. Our services include:

  • Facilitating communication between customers and restaurant partners
  • Coordinating food orders and delivery arrangements
  • Providing customer support for order-related inquiries
  • Processing payments on behalf of restaurant partners
  • Maintaining a platform for restaurant discovery and menu browsing

We act as an intermediary service and do not prepare, cook, or directly deliver food. All food preparation is handled by our restaurant partners, and delivery services may be provided by third-party delivery providers.

3. Eligibility and Account Requirements

Age Requirements

You must be at least 18 years old to use our Service. By using our Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

Accurate Information

You agree to provide accurate, current, and complete information when contacting us or placing orders. You are responsible for maintaining the accuracy of your contact information and promptly updating us of any changes.

Prohibited Use

You may not use our Service:

  • For any unlawful purpose or in violation of any applicable laws
  • To harass, abuse, or harm other users or our staff
  • To transmit any harmful, offensive, or inappropriate content
  • To interfere with or disrupt our Service or servers

4. Ordering Process and Policies

Order Placement

Orders can be placed by calling our customer service line or submitting a request through our website contact form. All orders are subject to availability and acceptance by our restaurant partners.

Order Confirmation

We will confirm your order details, including items, quantities, delivery address, and total cost, before processing. You have the opportunity to modify or cancel your order during the confirmation process.

Pricing and Payment

All prices are displayed in US dollars and include applicable taxes. Payment is due at the time of order confirmation unless otherwise arranged. We accept various payment methods, including:

  • Credit and debit cards
  • Cash on delivery (where available)
  • Digital payment platforms

Delivery Areas and Times

Our service is available in select areas across the United States. Delivery times vary based on location, restaurant preparation time, and delivery provider availability. Estimated delivery times are provided for reference only and are not guaranteed.

5. Cancellation and Refund Policy

Order Cancellation

You may cancel your order before it has been confirmed with the restaurant partner. Once an order is in preparation, cancellation may not be possible, and cancellation fees may apply.

Refunds

Refunds are processed on a case-by-case basis and may be provided for:

  • Orders that cannot be fulfilled due to restaurant unavailability
  • Significant delays beyond our control
  • Food quality issues reported within a reasonable timeframe
  • Delivery errors or missing items

Refund requests must be submitted within 24 hours of the original order time. Refunds will be processed to the original payment method within 5-10 business days.

6. Restaurant Partner Relationships

FoodConnect partners with independent restaurants to provide food preparation services. We are not responsible for:

  • Food quality, safety, or preparation methods
  • Restaurant operating hours or availability
  • Menu accuracy or ingredient information
  • Compliance with health and safety regulations by restaurant partners
  • Allergen information or dietary restriction accommodations

Any issues related to food quality, safety, or preparation should be reported to us immediately, and we will work with the restaurant partner to address your concerns.

7. Delivery Terms

Delivery Responsibility

Delivery services are provided by third-party delivery partners or restaurant staff. We coordinate delivery arrangements but are not directly responsible for delivery execution.

Delivery Address

You are responsible for providing accurate delivery address information. Additional charges may apply for delivery address changes after order confirmation.

Delivery Acceptance

Someone must be available to receive the delivery at the specified address and time. If no one is available to receive the order, additional delivery fees may apply for redelivery attempts.

8. Limitation of Liability

To the fullest extent permitted by law, FoodConnect and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities
  • Food poisoning or allergic reactions
  • Delays in delivery or service interruptions
  • Errors in order processing or communication
  • Damages resulting from third-party actions

Our total liability for any claim arising from or related to our Service shall not exceed the amount paid by you for the specific order giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless FoodConnect and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising from:

  • Your use of our Service
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Any false or misleading information you provide
  • Your infringement of any third-party rights

10. Intellectual Property

All content on our website and in our Service, including text, graphics, logos, images, and software, is the property of FoodConnect or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of our content without our express written permission.

11. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Dispute Resolution

Informal Resolution

Before pursuing formal legal action, you agree to first contact us to attempt to resolve any disputes informally. We are committed to working with you to resolve any issues promptly and fairly.

Binding Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States, and the decision of the arbitrator shall be final and binding.

Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as part of a class action, collective action, or representative proceeding.

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which our principal place of business is located, without regard to conflict of law principles.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be replaced with an enforceable provision that most closely reflects the original intent.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FoodConnect regarding your use of our Service and supersede all prior agreements and understandings.

17. Force Majeure

FoodConnect shall not be liable for any failure or delay in performance under these Terms that is due to fire, flood, earthquake, pandemic, government action, war, terrorism, or other causes beyond our reasonable control.

18. Termination

We reserve the right to terminate or suspend your access to our Service at any time, with or without cause, and with or without notice. Upon termination, your right to use our Service will cease immediately.

The provisions of these Terms that by their nature should survive termination shall survive, including but not limited to warranty disclaimers, indemnity, and limitations of liability.
